@ monsterworldwide March 30,2005 VIA FEDEX To Whom It May Concern: I am the Vice President of Litigation and Labor at Monster Worldwide, Inc. ("Monster"). As you are surely aware, Monster operates a web site located at the URL http:/lwww.monster.com ("Monster.com"), which is by far the most successful and widely used job placement and career resource on the Internet. Monster has used the Trademark MONSTER.COM continuously since late 1998 and is the owner of U.S. Trademark Registration No. 2,347,985 for its trademark MONSTER and U.S. Trademark Registration No. 2,403,411 for Monster.com, both of which are in full force and effect (the "Monster Marks"). As a result of the widespread use, advertising and enormous success of Monster.com, the trademarks MONSTER and MONSTER.COM have become exceptionally well known, and have acquired a substantial secondary meaning associated with Monster.com exclusively. It has just come to our attention that you are operating web sites at the domain names www.monsteriobs.org and http://wwwmonsteriobsorg.ezthemes. com constitutes a clear and willful infringement of our trademark rights in violation of Section 43(a) of the Federal Trademark Act, 15 U.S.C. §1125(a); is certain to cause dilution of the strength and quality of the Monster Marks in violation of the Federal Trademark Dilution Act, 15 U.S.C. §1125(c) and various state anti-dilution statutes; and constitutes common law trademarkinfringement and unfair competition. Please note that violations of the Auti-Cybersquatting Consumer Protection Act of 1999, Section 43(d) of the Federal Trademark Act, 15 U.S.C. §1125(d), may carry a penalty in addition to other remedies, of statutory damages of up to $100,000 per domain name. Accordingly, we demand your assurance, in writing, that (1) you will immediately cease and desist from all further use of the domain name www.monstercom.com or any other mark confusingly similar thereto; and (2) will transfer the www.monsteriobs.org and http ://wwwmonsteriobsorg.ezthemes. com names to Monster. If we do not have your prompt agreement on this matter, we will not hesitate to take appropriate further legal action to protect our valuable trademark rights, including initiating an action against you and your company in United States District Court, seeking preliminary and permanent injunctive relief, an award of all profits arising from your infringement, damages, costs and attorneys' fees. Please let us hear from you by no later than April 8, 2005. If we have not had a satisfactory response by that date, we reserve the right to commence litigation with out further notice to you.
